National Class Action Lawsuit Filed for Fuel Tank issues on multiple bikes.

    National Class Action Lawsuit Filed


    In November 2010, Girard Gibbs LLP filed a national class action lawsuit alleging that the plastic fuel tanks on certain Ducati motorcycles are defective because they degrade and deform due to an incompatibility with the motorcycles’ fuel. The suit alleges that this defect leads to a number of unsafe conditions, including destabilizing the fuel tank on the bike’s frame, fuel leaks, and interference with steering. The class action was filed in federal court under the consumer protection statutes of the State of California.

    2009-2011 Streetfighter and Streetfighter S motorcycles;

    2007-2011 Superbike 848, 848 NH, 848 Hayden Limited, 848 evo, 1098, 1098S, 1098 Tricolore, 1098R, 1098R Bayliss, 1198R, 1198, 1198S, 1198R corse SE, 1198S corse SE and 1198SP motorcycles; and

    We got a letter for the M1100S, but the "tank" that you see isn't the actual fuel tank. Those are just plastic covers, but the tank itself is molded plastic. We didn't respond to the letter, what are you guys doing?

    I'm not sure what I'm going to do. Technically this would be a moot issue if i put in the big CA tank. I need to go to a dealer anyway to have the trip computer software update applied, so may feel things out then.

    Got the letter also. I'm going to do a little research before I decide, but I'm not really keen to have a dealer tearing up my bike when it's working just fine as-is. At the moment my sense is that this is mostly a cosmetic issue for the bikes that have an exposed tank.

    I see the reference to 'fuel leakage', but so far haven't heard any stories of folks actually experiencing this.
